Terms and Conditions

INTRODUCTION

These terms and conditions (the "Terms and Conditions") apply to the sale of Original Artwork (the "Artwork") by Ginger Reddington (the "Artist"), a sole proprietorship, to you (the "Purchaser").

TITLE AND RISK

As soon as the purchase price is paid in full, the Purchaser will become the legal owner of the Artwork and, upon such payment, the Purchaser will be responsible for the Artwork, and the risk of damage to or loss of the Artwork will pass to the Purchaser.

OWNERSHIP OF THE ARTWORK COPYRIGHT

3.1  The Artwork can be purchased from the ©Ponderosa Studio (the "Studio") website, from one of the Artist's exhibit sites, or as a special commission by the Artist.

3.2  It is the Artist’s expectation that the Artwork will not be purchased for resale, but will be retained for the Purchaser's own personal enjoyment. Specifically, the Purchaser may not sell or offer for sale the Artwork on any Internet based auction or other website.

3.3  The Artwork contained in this site are protected by United States copyright law. ©Ponderosa Studio and Ginger Reddington, the Artist, have the exclusive intellectual property rights to all photos, images, text, videos and any other material or content included in this website.

3.4  Without the Artist's specific written permission, the Purchaser may not produce any image of the Artwork, and may not public, or submit for publication or reproduction, any image of the Artwork to a third party, including an Internet website.

DATA PROTECTION

The Studio and Artist may obtain personally identifiable information obtained from the Purchaser in the course of purchase of the Artwork. By agreeing to these Terms and Conditions, Purchaser agrees to such information being used in these ways and for such information to be disclosed to the Studio and Artist if the Purchaser is in breach of his/her obligations under these Terms and Conditions.

RIGHTS OF THIRD PARTIES

This website uses third party services, applications or sites that make available their content and services. When the Purchaser accesses those third party services, applications or sites, he/she is bound by the terms and policies of the third party.

PURCHASING POLICY

6.1  Payments are made through Stripe, a third party payment processor. As such, payments are subject to the third party's Terms of Service and Privacy Policy. Stripe accepts Visa, MasterCard and Discovery cards. The Purchaser agrees to pay Ponderosa Studio/Ginger Reddington through the payment processor, the full amount as charged which will include the base price of the Artwork as listed on the website, Washington State sales tax, handling and shipping.

6.2  Upon completion of an order, the Purchaser will be sent a verification email. The Artist will coordinate shipping, handling and tracking with the Purchaser. Usually shipping can occur on finished Artwork within seven days after an order has been placed and full payment received.  When the Artwork has shipped, the Purchaser will receive email notification which will include the delivery tracking number as applicable.

6.3  As an alternative, the Purchaser may arrange with the Artist to pick up the purchased Artwork from the Studio or from an exhibit site where the Artwork is being displayed. No shipping will be charged for picked up Artwork.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by the State of Washington. The Purchaser agrees that any action to enforce these Terms and Conditions will be brought solely in the State and Federal court.
